And today a white police officer got away completely with the murder of a black man on the streets of New York, even though there was a clear video of the cop choking the man to death while the man screamed that he could not breathe.


I demand hate crime charges be filed for the Murder of Mr Garner. If the feds don't do it, this country is going to rip apart.
It ain't always blacks killing whites.

So black on black crime shouldn't be discussed so often.

Actually, he said he couldn't breathe after being choked... but while a couple of cops were kneeing him on the chest.

I watched the video a couple of times and couldn't see him being choked after he was on the ground.  That was when you could hear him saying he couldn't breathe.

He died.

He died from what the cops did to him.
And the only crime they stopped him for was selling cigarettes.
They could have handed him a citation to pay a fine and walked away.


There is no excuse.

A civilized society can't keep accepting this behavior from peace officers.

The answer to the LEO issue is easy. Double and triple salaries, require more education of applicants, rotate in and out of hazardous duty positions from time to time, hazardous duty pay, long and regular vacations, stress days off with no questions asked, free and anonymous counseling, more scenario-based training.

But what's the answer to teenagers who hammer people to death?

Med examiner's report was no damage was done to the individual's windpipe and nothing indicated injury in area that would have affected breathing. This was a large man and he had asthma coupled with the increased physicality of resisting more than likely had an effect on the situation.

Having said that... when the officers did take him down to restrain him and his chest was compressed...not allowing him the ability to get full breaths of air along with possible asthma attack only forced his system to increase and place an even larger strain on his respiratory system...

What is once again on display the reaction of those that were not on the Grand Jury that listened to the testimony and evidence of the case...yet so many are suddenly experts...

'Joani'...you are correct when an arrest is going to be made and the suspect resists then officer(s) are forced to deal with the situation in front of them at the time...By reading some of the usual posts here there are some that certainly sound like they believe the last part of your post should be policy....ok he/she doesn't want to go to jail so we'll just leave sorry to have inconvenienced you---have a great day....

There's no such thing as a 'non hazardous duty position' and there are no 'routine calls'.... Certainly there is nothing wrong with more training and after these types of incidents...or any incident that goes to crap...they are used for training purposes--not to second guess or to judge but rather to learn from the situation...There is always room for improvement and to strive for more effective ways to handle situations but there are times when you got to deal with what you've got to deal with....

There second comment you made is very on point and is the part of the equation that seems to get overlooked in these situations...It's easy to second guess...criticize....condemn one side and yet the criminal side is excused from the same scrutiny and excuses are at the ready for their actions...

That's what the ME had in the report in regard to the neck/windpipe areas [no indication of damage(s) that would have caused the death by itself ] That was the report from the ME as explained by a physician---just the messenger of what was reported....Never said that there wasn't something or several contributing factors that caused the breathing problem....
IMO...believe it was the chest compression....positioning along with medical conditions that existed....If true then the jurors would have to take that all into consideration when hearing the evidence and deciding on criminal charges and intent...

You know some people can't stand to accept facts - arm chair quarterbacking and 20-20 hindsight is the new American standard......

I concede that his bulk and asthma was the underlying cause of his death... precipitated by the choking and the chest compression.  I suspect he wouldn't have died if he hadn't had preexisting conditions.

And I have to modify my statement a bit about him not being choked on the ground.  When he was taken down, there are a couple of seconds where he was still in the choke hold while he was on the ground, but he was released from the choke hold shortly after being taken down... and released from the choke hold before the video shows him saying he couldn't breathe.

The legal penalty for resisting arrest is not death. No one deserves to die for a non capital punishment crime. No one deserves to die for selling cigarettes on the street. If it were your son or daughter you would agree with me, I can promise you that.
People who support the cops in this country no matter what they do are aiding and abetting in the creation of a police state.


The coroner ruled Mr Garner's death a homicide. If the police didn't kill him then who did?
The video is clear and the coroner was correct.

Our grand jury system is screwed up by prosecutors who are in league with the police they work with every day.

And the whole system is aided by citizens who excuse police officers no matter what they do by saying "oh well, he resisted arrest, what do you think is going to happen?"

My answer to that would be that an officer with half a brain would consider the fact that the guy's only so called crime was to sell somebody a cigarette and would act a lot more reasonably in his efforts to deal with the HUGE crime. I know officers who would give the guy a warning about such a small offense and check and see if he continued it before even considering arresting the guy. I know officers who warn people smoking pot that they won't arrest them now but might if they see them again.
There's something to be said for police acting in the ways a reasonable human being normally would act and not act like Clint Eastwood in a movie. All crime is not equal. Apparently some people think it is.

If he was in a complete choke hold he would not have been able to speak. The guy was facing jail time. He was alredy out of jail on bail for doing the same thing. His arrest record consists of 31 arrests--31--that's a lot of arrests . Charges on Garner include assault, resisting arrest, grand larceny, and the sale of untaxed cigarettes. The cops don't make the laws....they enforce them.

Mediawatcher perhaps the cops need to institute the oops.....he doesn't want to go to jail.....and call King's-X and let him go.

Now for the kicker if Garner was a white guy taken down for resisting would there even be a discussion let alone nationwide attention? Be honest!

The cops have assaulted a lot of white guys, you're right about that and they don't get the public attention it does when they assault a black guy. The guy in Teo's picture was white (though after his mutilation and murder by the cops you couldn't really tell what color he was. Why did we hear about it? If I remember right, his dad was not only wealthy but a former police commissioner or a judge, I can't remember which . Whatever it was, he got the attention of the media because his kid was brutally murdered by police officers for no good reason too.
I don't care what Garner had done in the past, I don't give a rats whatever for his record, this was an arrest for selling cigarettes and the cops killed him during the arrest.
It's uncalled for under those circumstances, It's uncalled for under any circumstances other than the cops life being in danger. Lady, perps in this country get to have trials, they have the same rights to our system of justice as you do, and cops don't have the right to kill unarmed civilians before they can be prosecuted. The police are not judges or juries. They don't get to make those decisions. They don't get to decide guilt or innocence. I'm mighty glad you don't either.

Oh please....I never said death is a good sentence for a misdemeanor. His death occurred during an arrest by officers doing their job. Garner resisted. It is not up to the officer to decide what is legal or illegal. The State laws mandate that. Garner was out on bail for doing the same thing selling cigarettes.

Garner's so called resisting arrest consisted of pulling his arms away from the officer and asking the cop not to touch him. He did not assault any officer. He did not hit any officer.  It was on the video, you cannot deny that. You also cannot deny that  the choke hold that the officer used was  ILLEGAL under rules of his own department. It's not his right to decide it's legal when it is not. It's not his right to execute an unarmed man, but that's what he did.  Resisting arrest (by the way, his resisting was without violence, obvious from the video) and  is not a crime that deserves execution.  I know where you're coming from because I've read on here often enough that you believe cops are saints.

I hate to bust your bubble but many  of them are not. The police officer that killed Mr Garner broke department rules with the choke hold he used. He was filmed doing it. All the major news networks showed the film of him doing it and commented on the fact that it was ILLEGAL. He caused a death. He used an illegal choke hold and caused a death.
Doesn't matter if the guy had asthma, he wouldn't be dead except for the illegal use of force committed by that officer.
You could not be more wrong. Neither could our system of justice for allowing this kind of behavior to continue.

The feds are going to take care of this cop, I can promise you that. He won't be on the force after the DOJ indicts him for violating Garner's civil rights. You folks that don't like the federal government interfering in law enforcement issues should stop supporting cops that break the law. In the end, the feds are going to see that the right thing is done whether these rinky-dink grand juries are willing to do it or not.

Perhaps Gov Cuomo should cancel his order that established a task force to crack down on illegal [untaxed] cigarette sales in New York....If the laws are changed then there would be no reason for law enforcement to hassle those that are selling....But remember it's the businesses [store owners] that lead the charge to have a law put in place because the illegal sales were interfering with their customers and daily operations....

Now....Eric Holder [on his way out the door] has once again second guessed the judicial system this time in NYC, which is hardly a right wing city and his big brother DOJ is looking into civil rights violations...Later, Holder was in Cleveland addressing the 12 YOA that was shot because he possessed a air soft gun that looked like a real gun/pulled it out of his waist band when told to raise his hands...Once more big brother intervening in this case before there is even the judicial process completed...There is an attempt to link all these incidents to the Martin case...Ferguson case...when they are all different...The cowh holds press conferences and makes statements like...we will not let up....we?...Agree or disagree in the Martin/Brown and Garner cases the 'we(s)' made a decision about criminal maters and not everyone will agree with their decisions but to have holder's corrupt doj second guess these cases because of the racial components is utilizing his authority in matters because of his personal biases...which sounds like what some charge as being racist when the situation is reversed....
