Women Accidentally Shot by LAPD Won’t Get New Truck, Despite Promises

Quote :
After their truck was plugged with more than 100 bullets, two women accidentally shot by the LAPD in the manhunt for Christopher Dorner are not getting the replacement vehicle they were promised over a month ago.

NBC 4 in LA reports that 71-year-old Emma Hernandez and her daughter, who had been delivering newspapers when eight police officers opened fire on them out of the blue, no longer want the new truck after being told they'd need to pose for a photo op and pay income tax on it. The truck was valued at $32,560.

According to [the women's lawyer, Glen] Jonas, LAPD and Galpin Ford wanted his clients to pose for a photo opportunity and pay income tax on the truck. The women no longer want the truck after they were told they needed to fill out a 1099 form for the donation, Jonas said Monday.

"You tried to murder the woman, now you're telling her she can't have a four-wheel drive, you're telling her she can't sell it and you've got to be taxed on it?" Jonas said. "How would anyone react to that?"

Jonas plans on filing a government claim, which is a precursor to any lawsuit filed against a government agency. He said he felt the truck was being touted as a "reward or prize" instead of a sincere gesture by the LAPD.

Aside from that being typical horrible behavior of people who live in LA... (don't get me started)

WTF? That's a Tacoma... wasn't Dorner driving a Nissan pickup??? They don't look anything alike! I'm sorry but if you can't tell the goddamn difference between a Toyota and a Nissan you should not be a frigging cop. Should be like a job requirement or something.

And woah there, Trigger. 102 shots and not one of the two women was hit?? I mean yeah, that's a good thing in the end, since LAPD was shooting (once again) at innocent people, but JESUS, those guys need some frigging target practice! That's scary.

That's what I was thinkin'. With over a hundert shots fired, you'd a thunk somebody would have been hit.

Okay, well *some* good news: LAPD has agreed to compensate these gals $40k for the loss of their pickup, AND the hotshots at LAPD managed to land 1 out of 102 shots fired at their targets. Per below article, one of the gals (the 71-yr old mother) was shot in the back. Good for them. They must be so proud.

Take note of the last paragraph in the article.

LA compensates 2 for truck mistakenly shot by LAPD
By LINDA DEUTSCH, AP Special Correspondent | March 14, 2013 | Updated: March 14, 2013 7:00pm

LOS ANGELES (AP) — The city has agreed to give $40,000 to two women whose pickup was shot up by a Police Department protection detail that mistook their newspaper delivery vehicle for the truck driven by rogue ex-cop Christopher Dorner during his rampage, officials announced Thursday.

The tax-free settlement covering the pickup and other property came quickly after the women's attorney, Glen Jonas, rejected Los Angeles Police Chief Charlie Beck's offer of a replacement truck because the women would have had to pay taxes. The deal specified no admission of liability.

Margie Carranza and her 71-year-old mother, Emma Hernandez, were delivering papers around 5 a.m. Feb. 7 when LAPD officers guarding the suburban Torrance home of a Dorner target blasted at least 100 rounds into their Toyota pickup. Hernandez was shot in the back and Carranza had minor injuries.

Jonas said the women were still not doing well.

"Margie's still very emotionally impacted and Emma is suffering from her injuries," Jonas said.

Jonas, who noted he has waived all his fees, said he hoped that all other issues including personal injury can be resolved without the need to file a lawsuit or have a trial.

City Attorney Carmen Trutanich said the truck compensation was one of the fastest resolutions of a case he can remember in his term.

The women were expected to receive the money in two to four days.

The errant shooting in Torrance occurred just hours after Dorner shot and wounded a Los Angeles police officer in Riverside County and then ambushed two police officers in the city of Riverside, killing one and wounding the other.

Dorner was on the run in a Nissan Titan pickup after being named as the suspect in the murders of a retired LAPD captain's daughter and her fiance. The former captain had represented Dorner at an LAPD disciplinary hearing that led to his firing. The double-murder investigation led to discovery of a manifesto posted online by Dorner that vowed to wage war on Los Angeles police.

Dorner hid out in the San Bernardino Mountains until Feb. 12, when he tried to flee but law enforcement converged on him. Dorner killed one sheriff's deputy and wounded another in a gunbattle that ended with fire consuming the cabin he holed up in. Authorities believe he killed himself with a gunshot to the head.

The attack on the women's pickup truck wasn't the only mistaken police shooting that morning in Torrance. Moments later, nearby local police opened fire on a pickup truck driven by a surfer heading to the beach.

They could have avoided this if they'd just handled this right out of the gates and offered to replace their pickup...

Los Angeles to pay $4.2 million to two women fired at in Dorner manhunt
LOS ANGELES | Tue Apr 23, 2013 9:38pm EDT

(Reuters) - The city of Los Angeles will pay $4.2 million to a mother and daughter who were caught in a hail of bullets in February when police mistook their truck for one driven by renegade ex-policeman Christopher Dorner and opened fire, officials said on Tuesday.

The settlement, which allows both sides to avoid a trial, brings the Los Angeles Police Department nearer to closing what had been an embarrassing chapter in its search for Dorner. The department still is reviewing the actions of two officers.

Dorner, a former Los Angeles police officer accused of killing four people in a vendetta against the LAPD, died on February 12 in a fiery standoff with officers in the mountains above Los Angeles.

The shooting-related injuries of the two women, who had been delivering newspapers in the Los Angeles suburb of Torrance, occurred in the first days of the manhunt for Dorner.

Emma Hernandez, 71, was shot twice in the back and her daughter, Margie Carranza, 47, suffered hand injuries from flying debris when two officers opened fire on them before dawn on February 7.

Police had been on the lookout for Dorner's gray Nissan Titan truck, and officials have said the officers opened fire after mistaking the blue Toyota Tacoma the women were driving for Dorner's truck.

"In reaching this settlement, we hope Margie and Emma will be able to move on with their lives, the city will be spared millions of dollars in litigation expense and time, and this unfortunate chapter of the Dorner saga will be put to rest," Los Angeles City Attorney Carmen Trutanich said in a statement.

Each woman will receive $2.1 million under the settlement, which must still be ratified by the Los Angeles City Council.

In March, Trutanich reached a separate settlement with the women that gave them $40,000 to replace their truck, which was left with multiple bullet holes.

"They are still grappling with a whole range of emotional issues related to the incident," said the two women's attorney, Glen Jonas.

Los Angeles police spokesman Chris No said the settlement does not affect the department's investigation into the shooting by the two officers.

"The department has not yet made any determination regarding the propriety of each officer's action or any potential discipline related to this use of force," he said.

The officers remain assigned to desk duty as part of the investigation, he said.

Along the same lines... cops "exchange gunfire" for an HOUR with Boston bombing suspect... only thing is... he didn't have a frigging gun!

Officials: Suspect unarmed when arrested in boat
By ADAM GOLDMAN and PETE YOST
Associated Press / April 24, 2013

WASHINGTON (AP) — Two U.S. officials say the surviving suspect in the Boston bombings was unarmed when police captured him hiding inside a boat in a neighborhood back yard.

Authorities originally said they had exchanged gunfire with Dzhokhar Tsarnaev (joh-KHAHR’ tsahr-NEYE'-ehv) for more than one hour Friday evening before they were able to subdue him.

The officials, speaking on condition of anonymity because they were not authorized to discuss the ongoing investigation, say investigators recovered a 9 mm handgun believed to have been used by Tsarnaev’s brother, Tamerlan, from the site of a gun battle Thursday night, which injured a Massachusetts Bay Transportation Authority officer. Dzhokhar was believed to have been shot before he escaped.

The officials tell The Associated Press that no gun was found in the boat. Boston Police Commissioner Ed Davis said earlier that shots were fired from inside the boat.end of story marker

Don't get me wrong about the Boston bomber. The scumbag just got a taste of his own medicine...

"violence begets violence" (Martin Luther King).

My point is that some innocent person in the area may have been the victim of a stray bullet from this, ahem, gunfight. Police are way too eager to pull their triggers, IMO.

In a way, I sympathize with them because this is their job and there are lots of scumbags with guns out there that wouldn't think twice about shooting them.
